Obama’s Administration Vetoes Ruling Against Apple Inc

The battle between Samsung and Apple continued as the Obama Administration vetoed the product ban on older iPads and iPhone produced by Apple. According to the Wall Street Journal, Obama voted against the ruling made via the ongoing patent litigation between Samsung and Apple Inc.

American Trade Representative Michael Forman also vetoed the product ban but he added that Samsung could continue to pursue its patent rights in the courtyards. Apple responded through AllThings D, stating that Samsung has been abusing the patent system for a long enough and the time has finally come to stand up for innovation and creativity.

“U.S. Trade Representative Michael Froman made the decision to veto the ban on the Apple devices, citing concerns about patent holders gaining “undue leverage” as well as potential harm to consumers and competitive conditions in the U.S. economy.He said Samsung could continue to pursue its patent rights through the courts”, iphoneincanada.com reported.

“We are disappointed that the U.S. Trade Representative has decided to set aside the exclusion order issued by the U.S. International Trade Commission (ITC). The ITC’s decision correctly recognized that Samsung has been negotiating in good faith and that Apple remains unwilling to take a license,” Samsung responded.

Samsung, on the other hand, was extremely disappointed about the ruling made by the Obama’s administration in favour of Apple.  It was also the first time in almost 17 years, the US president had to use his veto power to life an important ban imposed by the United States International Trade Commission. Samsung does not have the right to appeal the decision but as discussed before they can continue their battle against Apple in American courts.

A couple of months ago the US ITC imposed a ban on the iPhone 4, iPad 3G and iPad 2G and AT&T for violating a Samsung patent. The ban was set to be imposed in the first week of August 2013 but Obama Administration stepped in to vote against the ruling.

“The Obama administration stepped in to veto the ITC ruling one day before the ban was set to be imposed on August 4, 2013. Last week, the trade group BSA, which includes the likes of Microsoft, Oracle, Intel, AT&T and Verizon, voiced their concerns to say the use of essential industry patents to ban products should not be allowed, which Samsung was doing. Looks like the US Federal Government agrees with the decision to veto the ITC ruling”, iphoneincanada.com added.
