iCloud Lands Apple In Court Because Of Patent Infringement Allegations

Apple has been battling several lawsuits for intellectual property in courts around the world including the highly publicized battle against South Korean rival Samsung. The California based manufacturer of the iPhone may find itself in another court room because of a patent infringement claim from Innovation Automation. The San Jose based firm is claiming that Apple’s iCloud service are infringing on two patents that they own.

 

Innovation Automation states in the court documents that iCloud is using technology that the company took ownership of in 2007 and 2008. Apple is not the only one to be it with a lawsuit from Innovation Automation who have also filed cases against Amazon and Spotify using the same two patents.

 

According to court documents, Apple’s iCloud, Amanzon’s Kindle and Spotify’s online music streaming service all infringe upon US Patent No. 7,147,362 and 7,392,283. These are both owned by Innovation Automation and are a “Method and system for supplying products from pre-stored digital data in response to demands transmitted via computer network”. According to Innovative Automation the iCloud service utilizes the exact same method that it has stated in its patents and thus violates intellectual property laws as well.

 

The San Jose firm has not claimed any specific damages against Apple or the other two technology firms. However, it has mentioned that because of its patent holding, Innovation Automation should receive licensing payments from all of the aforementioned firms. They are also looking for the Apple, Amazon and Spotify to pay for their prejudgment and post-judgment costs plus interest.
